Michael, spokesperson for Koch Media, just explained on the cinefacts board that they opted for Dolby Digital 2.0 for The Punisher because they noticed that there are problems with the surround sound with the DTS HD Master audio. This happend when the mediabook was already produced.

You can think of this what you want, but his statement sounds pretty honest. You can read it in full length here (he also comments on the quality of the unrated scenes and the artwork, the latter receiving a lot of negative response):

I love the artwork on The Punisher mediabook EXCEPT them sticking part of that tagline across his head. It's pretty annoying actually.

Word on the street is that it may be coming from Arrow too this year.

That Koch cover is really awful though.

Okay, fyi, I played them through the PS3 onto a new (ish) 47 inch led tv.
I couldn't tell them apart at all. To be honest I don't think anyone else could either unless you got a 100 grand setup, but even then...
Someone mentioned that the black tones were very milky but I cannot say I had that problem on either disc. The blacks were pretty solid, a bit of grain - but I prefer that to too much noise reduction, and quite frankly you will never get a better release on a home viewing format.
Considering the mediabook is limited to 1000 and already on ebay for £99.00 (!!) then the BU release is the way to go.
But secretly you'll know you really want the highly collectable German one!
