Because they are appointed the statutory body under the Video Recordings Act. As some people stated in this thread, they don't have the power of banning as such, as you're allowed to own an unrated DVD; just not sell or supply it. But if they refuse it a certificate, then it makes it illegal to sell or supply, therefore stopping distributors from selling their DVDs, effectively banning the sale, but not banning ownership.

Though, good to remember that if a DVD contains material that breaches other UK legislation then it is illegal to own.

And unfortunately as has been said before, even in 18 rated material, they cut stuff that breaches no UK laws, only their superior morals.
