I don't think it fits the definition I put in the original post, because the people illegally entering the premises are not doing so to commit a crime and the homeowner, and only occupant, is dead, leaving the house apparently empty (although there are people, who also broke in, seeking shelter in the basement) and without an owner.

"A home invasion is an illegal and usually forceful entry to an occupied, private dwelling with violent intent to commit a crime against the occupants."

76, 06 version is alright

I saw the 2006 version and thought it was okay but nothing special. I then saw the 1979 version and realised the people behind the remake of the right idea because the original kind of falls flat halfway through when the "Have you checked the children" part is over. It's been years since I've seen them, but I think the remake compares very favourably to the original.
